I've tried calling Summitt Energy but they say that I'm not in the system yet. I'm trying to get the call in before the 10 day point - I'm wondering if I'm contractually obligated after the 10 day point or if it's after the 61st day.. I'm hoping it's after the 61st day.

Universal is relying upon our Great Canadian Consumer Protection Act in which, now get this, we the consumer have only 10 days to cancel a contract where the retailer has up to 60 days. Now, I'm in the process of researching exactly what we have to do as Canadians to follow these steps but while I investigate into that let me inform you of who Universal is and what their about.
They are not Canadian, their goal is not electricity and gas but????
YOU GUESSED IT OIL OIL OIL....Universal itself in 2004 borrowed monies to finance two oil riggin' stations. Very expensive this oil industry, anyways, guess how long they have to pay their loan back? 5 YEARS.

All I have to say is this, we as Canadians, no matter our creed, color or religion must ensure that those we place in positions of power are very closely watched. We have become lazy and reliant on the mere fact that we trust in what they do......POWER CORRUPTS REMEMBER.

I'm very glad to have found this forum, which has confirmed my suspicion that today's visitation was an attempted scam. It's amazing how familiar all the details are: the mile-a-minute, obfuscatory talk about deregulation, the demand to see a gas bill, the assurance that everyone else is signing up, the irritation when we didn't want to show them a bill...

I wasn't home when they rang the doorbell, but I was on the phone with my girlfriend when she answered it, so I got to hear their conversation. Pretty quickly, he actually PUSHED his way into our house and she yelled at him that he was being intrusive and that he had to leave immediately. He sulkily apologized and left, fortunately without her ever having produced a gas bill, signed or verbally agreed to anything, accepted any literature, or OK'd a follow-up call.

If he shows up again at our building and I'm around, I swear it's going to be a toss-up between calling the RCMP and bludgeoning him to death with his clipboard.

I sent them an email a couple of days ago because it's been a month since they sent me an email saying they will be sending a cancellation letter within 5-15 business days.

I got a response last night with that EXACT SAME email they sent last month (did they forget to send me the letter last month??!). So I told them that I want an actual response of CONFIRMATION that they sent it out, not a stupid duplicate of a previous email, and that I would take further action if it is further delayed. I guess I will call them tomorrow.

This was their email, probably just copied and pasted by one of their idiotic staff:

Thank you for writing to Universal Energy Corporation. We have received and submitted your cancellation request to our Customer Relations Department. A response will be sent to you via post mail within 5-15 business days.

Wow, they keep coming back! Unfortunately I'm always at work when they come by, and my girlfriend, who's been trying to finish off a really difficult paper at home (we're grad students), has been having to deal with all of it.

Three days in a row, always different people. When my girlfriend slams the door on them, they start ringing the doorbell again 30 seconds later! At this point I'd want to wring their necks if they were UNICEF or the Heart and Stroke Foundation--the fact that they're a shady company is just the icing on the cake.

I want to ask them: if you were a legit company, would you be pressuring us like this, in the face of repeated angry rejections? Bell wants me to switch to their long distance plan, but they send pamphlets in the mail, not a pack of sneering thugs to my doorstep.

Anyway, if they come again, my girlfriend is going to tell them that this constitutes harrassment and call the police.

Our window is also right above the front door of the building, which might argue for some medieval boiling oil tactics, as well. At least a water balloon.

I too have apparently been scammed by this. On December 21 2007 I signed up for what I thought was an application not a contract. I told the sales rep I wasn't signing up but would review the material and then make a decision later. I naively gave them my hydro bill and consumers gas bill, which they said would be returned (I thought it was part of the application process). I didn't get a chance to review their materials within the 10 days since it was over the holidays. I finally sat down tonight to review and came accross this forum. I did read in the contract terms that under the Ontario Energy Board Act, 1998, I need to reaffirm this Agreement, which I have not. My plan is to tell them to cancel when they call or I will call them. Is there anything I can do to ensure this will be cancelled. How can I get proof that I haven't reaffirmed.

Thanks for any assistance.

to snrdrummer....Call them immediately! Tell them you don't want to go with their company, and ask them for a cancellation number. It's good that you didn't get a call from them, however, I would cover all bases, and call them, write to them, fax them, e-mail them, etc. My only question to you, is did they call and speak to anyone else your household? The impression I get is that it doesn't matter who answers the phone and talks to them. As long as they get a phone verification, they deem that as you agreeing to the contract. So, again, don't hesitate, call, fax, e-mail, phone as soon as you can!

I tried to scam the scammers but they may have got me. Never the less i'm not giving up.

I knowingly signed their agreement at the door with the intent to cancel during re-affirmation.

It's worked in the past.

When i hadn't heard from them, i asked my wife if she had received any calls from these crooks she said, oh yeah maybe, i just told them whatever. if he said he wanted it then go ahead.

As i fell to the floor, i could of cried, it wasn't her fault, i didn't tell her of my plan. I thought they would have to talk to me, after all it was i that signed it.

I immediatley called UEC to rectify the situation and the girl thet answered the phone said it wasn't a problem, that i was already signed up with another supplier and that they could not sign me up anyways.

I have no idea what that was about but accepted it anyways.

a couple of months later I'm getting this rediculous electricity bill.

When I called to explain they basically said, so sad too bad.

To say i was pissed would be putting it mildly.

Here it is January 29. 2008. This started in June of 2006.

I have written emails to UEC, the OEB, the MGS, my MPP, which in turn forwarded my letter to the Minister of Energy, with no real signs of success.

None of these entities really seem to give a sh care. They merely symathize with you. Big Deal.

In my particular case I am arguing the law of "Form of Consent".

The OEB claims that these crooks must abide by the "Consumer Protection Act of 2002"

Which states,

Form of consent
(5) A supplier may rely on a consumer's consent to a material change that is made orally, in writing or by other affirmative action but the supplier shall bear the onus of proving the consumer's consent. 2002, c. 30, Sched. A, s. 13 (5).


A consumer is described as follows,

Interpretation
1. In this Act,
“consumer” means an individual acting for personal, family or household purposes and does not include a person who is acting for business purposes; (“consommateur”)

My interpretation of an individual is a single person. If i signed it then i must re-afirm it.

Furthermore if that fails i have one more,

Ambiguities to benefit consumer
11. Any ambiguity that allows for more than one reasonable interpretation of a consumer agreement provided by the supplier to the consumer or of any information that must be disclosed under this Act shall be interpreted to the benefit of the consumer. 2002, c. 30, Sched. A, s. 11.

I'm sitting here on the eve of doom.

I've received what I believe is my final warning from the Collection agency that these crooks have hired.

Couldn't care a less. I'm prepared to go to the mat on this one. I don't care how much it costs.

I look forward to my day in court. Let the Judge decide.

I put my account into someone elses name, that does not live in my residence and as you can see from my initial post they will still come after you.
However, UEC claims that if you move and where you go does not require you to purchase electricity, they will let you go. I might add they want proof.
ie. employment record, drivers license, phone bill... If you tell them you are moving into a rental they may even want a letter from your new landlord.
It can be done, but it can get complicated.
I seriously considered it and then I figured screw it, I'm right, they're wrong, and I'm going to fight it.

I recently got scammed into signing with universal power, my mother and i recently brought a house (our first time) we knew nothing of that sort I had a reprenstative come to my door stating that they were with the gas and electricity company and they needed to see if i hav recieved my bill for this month, they were doing a door to door check I assumed it was procedure and handed him my bill he then told me that I had to sing to confimn that he came to the door and that i had my bill, I later recieved a call asking me if i wanted to confirm i said no. They then added my mother without her permission or consent or signature to ther account my mother has no idea what the hell is going on, i called them yesterday and this is where they fukked up they told me that there was no need for a written consent because they sent my mother a 25 dollar check and that confirms the account; I have gone to our bank and requested a statement showing from the time we brought the house dec 1 to now that there was no transaction made with a 25 dollar check and that they were wrong; i've sent them via fedex and have a confirmation number to prove that the statement has been recieved and now they can't say anything, i am just waiting for my cancelation number i also proceeded to call consumer relations who is now doing an enternal investigation and i've recently wrote to the better business bureau and field a complaint. They have no proof of me confirming this and i no longer have an account,

seriously guys be persistant, call anyone and everyone possible, find proof, find a loop hole and fuk them over, they are vultures, mindless idiots, I just call to give them a hard time just for the fun of it when i'm bored lol. and they hate it , next time they come to your door spray them with airfreshener lol it's not assult when it's a house hold item, be mean these people could care less about you.

I'm just wating for a reply from then but as the guy stated, the confirmation was made by a check that was cashed out as of jan 3rd and we have proof that it wasn't. there's nothing else to be said. find a loop hole listen carefully to what they say to you and how you confirmed maybe you can find something to prove them wrong.

i haven't read all of the responses, but clearly i've not been the only one taken to the cleaners by this company. in fact, i just got off the phone with them after receiving a notice from my local hydro company announcing yet ANOTHER price decrease ... figured it was time i asked for the "blend and extend".

well, it turns out the lousy sales person forgot to mention (among a ton of other things) that when you ask for the current lower rate, it also means you sign on for a renewed five years. uh, no thanks, moron.

i'm already two years into this contract and losing money hand over fist. i live in a rental that my local utility company even agrees something is wrong with. our hydro consumption is almost double what the other five rowhouse units are, and of the six employees i've spoken with from the hydro company, ALL have agreed that there is something wrong with the wiring. our consumption is ludicrous. i'm surprised the cops aren't busting us for some some suspected grow-op!!!

so to make matters worse, we're paying for hydro that isn't ours, and it's at a rate of 9.59 cents / kw hour!! almost double what i would be paying if i hadn't signed on. that's taken my bill from $275-300 to $500-550. And we're the most conservative/green people you can imagine!!! not that it helps in this screwy house.

to make matters worse, Universal STILL comes around every few weeks ringing my doorbell around dinner time, in spite of the No Solicitation sign. i've already decided that the next time they come here, i'm going to hand the bastard my cordless phone and tell him or her to dial 911. i'm going to tell them as calmly as i can to ask for an ambulance for themselves and the police for me because i'm going to beat the living sh*t out of them if they don't get off my g-damn porch.

crumb, i can't quite tell from your previous post how this thing played out for you. a credit/collection agency came after you when you switched the name on the utility bill?

i was thinking of changing the utility bill to my partner's name, and telling them i'd moved in with my parents where i wasn't paying utilities.

of course, in the fine print they still indicate that there's a fee for "Early Termination Damages" and it is based on "Projected Future Volumes" ... which - in my case, with a possessed house that consumes twice the energy it should - will be ridiculously high.

THIS IS NOT A SCAM. You signed a contract that you did not take the time to read.

it cost me $831.00 to get out of my contract. SUCKED TO BE ME!!

The reason the collection agency is after me is because I put my Electricity into another persons name and quite proudly told UEC that I still lived here and that I disagreed with their re-affirmation policy.

Through this lengthy process I found out from them that if I moved into another dwelling where I didn't pay for electricity, they would let me go free and clear. The early termination fee only applies if you did what I did.

However, they did say I would have to prove that I did in fact move, ie: Drivers Licence, Phone Bill, Pay Stub, something to show that you moved. They also mentioned getting a letter from my new landlord.

If you are in good terms with your parents this may not be too hard. You can just collect some of your mail over there until the smoke blows over. I doubt there going to hire an investigator to watch your movements for $500- $800. It's not like it's Welfare Fraud.

I chose to go the route I did because had I signed the agreement and then re-affirmed it then it would have agreed with "bigtrout". I didn't re-affirm the contract my wife did and to Mr. Trout, i have read the contract several times and no where does it state that anyone in the dwelling above the age of 18 can re-affirm the contract as UEC believes. For starters, it is an application request that under the terms of the consumer protection act is not complete until the consumer re-affirms it. If you read the CPA 2002 you will find that a consumer is defined as an "INDIVIDUAL". Not a collection of adults that dwelling. So in my opinion if you sign the application then you have to be the one to re-affirm it. Plain and simple.

Hello all,
Just received my wonderful $225.00 hydro bill for my one bedroom apt.After calling the local hydro provider I was informed that I was not eligible for the equal billing option,so that my winter hydro bills would not drain me,the reason being that I do not receive my hydro from Kitchener Hydro,but from UEC. I cannot count the number of times I have said no to the representatives that knocked at my door. In fact I remember signing a contract and canceling it within 10 days.Some how now they told me that I was phoned and my contract was approved by phone.I have been informed as others may have that if I move and my new residence has hydro included that I will be charged a cancellation fee but only after I send them a copy of my new lease.If I move in with someone else that pays the hydro,I will still be charged,If I cancel for any reason,I will be charged,but no one will even tell me what the fee will be.It is truly a scam,but a legal one.Just the other evening,about 7pm,a representative from "ontario Hydro" came to my door asking to see my hydro bill,to make sure that the proper discounts were given , only todayu did I realize that it was one of "their" representatives.While speaking with the customer representative for the company she tried to calm me by telling me that the representatives that sell the program were all going to be retrained,because there approach was not honest or correct,but in the mean time I guess we are all screwed.I too have been given an addy to contact the representative to cancel the contract,but at least it was an email.After reading these post I too will contact Mcguinty and my local mp.Just out of curiousity,what happens if we get the bill for the cancellation fee and we don't pay it?If we choose to fight it,will that stop us from receiving Ontario Hydro from our local provider,anyone have any idea?
