hi everyone, here's the update in regards to me taking universal to court. by the advice of my lawyer, i've decided to settle with them and pay about $500 to get out of the contract. the bottom line is they had the signed the application/contract and voice recording (re-affirmation of my application) as evidence. If I only knew and had a recording of their rep and the tactics they used then I would have a great case.

slam the door on these people if they come knocking. you have been warned. DO NOT GET SCAMMED!!!

there's got to be a way to put this company out of business.

Hi everyone,

I have read though this lengthy trail and all I can say is WOW! I too had Universal come to my door 10 days ago, and I signed what I thought was only an application. They called me last night, and I told them I needed the weekend to review the information with my husband. After that call, I did some research, and talked to my sister who locked in with another company 2 years ago (not Universal). What I discovered was that the natural gas price they were offering was way higher than my most recent gas bill, and when I reviewed the last 3 years of bills, I discovered that there was only 1 month where the natural gas price was anywhere close to what they were about to charge me. Also, their agent said to me at least 4 times, that I needed to contact Universal to set up the contract, never telling me that they would phone me. He emphatically told me that I was NOT signing a contract, only an application. He also told me that I was to call them after 10 days, and that I had to wait until after June 8th to do so. He told me that the 10 day rule was so that I had adequate time to decide. Is this so that I would be automatically locked in if I didn't call in time to cancel???

I'm so glad that I found this information on the web when I did. I immediately sent them an e-mail last night saying that I did not want to sign up. I also called this morning and again told them I didn't want to sign up, as the prices were way too high. The agent I spoke to on the phone (Hiba), said that she was cancelling my contract, and gave me a cancellation number. I truly hope this means that I have not signed up with them, and will be watching my bills very very closely over the next few months. I plan on calling Enbridge today as well to let them know I do not want to change suppliers. I feel so paranoid right now that I'm covering all bases!

I am completely kicking myself for signing on the spot. I never ever do this and I keep asking myself why I signed. Lesson learned - I will never ever sign at the door again. This is not to say that signing a contract for more stable gas prices is a bad idea. On the contrary, I think it is a good idea, and one worth researching. If this company were truly on the up and up, they would have dropped off their literature, and left it up to me to research more. Has anyone noticed that their literature is an exact duplicate of their website? They offer no additional information of any kind on their website – isn't that where you are supposed to find additional information? I searched for gas pricing on their website, and found none. Also, I found none on their brochures. The only place I could find the actual price was on the "application" that I signed. Again, if they were truly on the up and up, the prices would have been all over their website. In my research, I went to riterate.ca to check their prices, and they are right there on the website.

Lesson learned - I will never ever do that again, and let's hope I have averted a long ugly mess. (sorry this is so long!)

Feeling regretful in Scarborough,
Nadia

An update to my post on Friday. I did receive a reply e-mail from Universal late on Sunday saying that they were cancelling my contract. What I find quite irritating (and mind-boggling) is that they told me it will likely take 1-2 months to get Universal off of my Enbridge bill. Why, I question, would Universal even submit the request to Enbridge when I hadn't even confirmed agreement to this contract???? I replied again, and told them that should there be any charges for gas at their rate, that I expect to be reimbursed for the overage. I also copied in the Ombudsman for Enbridge. Now, let's see what happens!

I regrettably got into the contract. I will not recount my story as I have read it over and over again.

My early termination fee is close to $800.00. Paying it now will save me an estimated $3000 in the long run. How pathetic is that?

The one thing that I feel "duped" by is this "balancing charge". I am not only paying for my usage, I am also paying for excessive usage in my "rate class". When I inquired about this I was referred back to my contract. Of course it is there, written in cryptic terms that only an industry insider can understand. Apparently they only purchase power at 90% of expected usage. Anything usage over and above that is charged on a pro-rated basis to all members in thie "rate class". No, I don't get it either.

I am interested in joining a class-action lawsuit. If anyone knows of one that has been started, please post the details.

hi everyone, i had a lot of people emailing me about my court case with ue. anyways, i figured i'd post one of the response so it would save me a great deal of time and repetition from answering the same questions. i hope someone knows the game and take ue out of business. the following is a cut and paste from my reply to one of the victims of ue.

"hi anita,

sorry to hear about your dilemma with these bloodsuckers as well. wow it seems cancelling their contract seems to vary from person to person. when i had found out that they switched me, i immediately contact them and wrote to vanessa anesetti (one of the bloodsucker from ue)

she told me the contract termination would be somewhere close to $600. i said, 'see you in court' and hung up.

perhaps more people should threaten them with a lawsuit or something. that's about all i can tell you and from my post on the forum. knowing that they had spent more than $1000 in legal fee is good enough for me. i'm not sure if it made a dent in their pocket but if more and more people do it, it will eventually hurt them and take them out of business. good luck! I think I should post this on the forum as well."

Hi, we got a person from Universal energy at our door 2 days ago (June, 13). After a long discussion she eventually convinced us to sign an "application" and give her one of our hydro bills. After that I googled universal energy and I found this and others forums posting all the problems with them. Thanks to all you guys that posted your stories to warn us!!
So we called the day after and saying that we wanted to cancel our application but we were told that they didn't have it "in the system" yet, and that we should wait to receive a call and cancel at that time.... yes right!...
So I called again today and after being the told the same story I asked the guy to speak with a manager, he said that the manager was not there right now and when I insisted he HUNG UP on me!!! When I called again the line dropped off immediately, I guess they recognized the number!! So I called from my cellphone and I spoke with someone else, I insisted again to be cancelled immediately and to talk with a manager, at first she said it was not possible, after asking again she finally said she was going to to a cancellation for me!! This means that you can cancel immediatley don't give up if they tell you that you have to wait. So I have to give again all the info (name address, hyrdo account #.. ) and I got a cancellation, with a cancellation number. So I'll keep my radar on for any phone calls from them but I hope I got rid of them before being hooked up.
I really hated their way to do "businness" I think the government should be informed of this.
Good luck all of u,
say NO to Universal Energy!!

I have also been suckered in. They are just so convincing at the door, so nice and polite, making you think if you don't sign, your stupid for not doing so. My hyrdo bill comes in around 350 to 400 dollars now, I hate to think what it will be now that the air conditioning is on. I think I may have found a way out of it. I will let you know.

I just send one of these Ontario Energy Saving L.P. reps packing. However I did let this guy look at my hydro bill and start writing up the contract. I started having doubts part way through the conversation and did not sign the contract. I should have torn it up as well. This guy will probably forge my signature and submit the contract anyway.

Shelllly, when you find a solution, I would love to hear it.

Thanks,

Message for WillowdaleTom:

First of all, hopefully you got the name of the agent at your door. I would strongly recommend that you call them, e-mail them, and snail-mail them to make sure that they don't sign you up. It is good that you didn't sign, but I would still be very very careful. If you live in Willowdale, I wonder if it is the same guy that came to my place (I'm in Scarborough, just east of Willowdale). He was very very nice, and quite convincing. He actually convinced me that he was doing me a huge favour by signing me up. At the end of our discussion, he asked me to rate him on a scale of 1 to 10. I can't believe I actually told him that he was very helpful! I feel like such a fool now.

I just received my Enbridge bill today, and I'm so happy to say that I have successfully avoided a UE take-over! Yippee!

So, if you are still within the 10 day window, I would definitely follow up with them, regardless of whether you actually signed anything or not. If they have your account number, then from previous posts, it sounds like they will try to sign you up anyway. Also, from previous posts, be very very careful if they phone, as it sounds like they can have you agreeing verbally you pretty easily.

Good luck WillowdaleTom.

Nadia,

I spoke to the Energy Savings group yesterday. So far I'm not on their list. I guess I need to follow up with them again in a few days.

Thank you for your advice, Nadia. I appreciate it.

Howdy!!

So,has anyone found out a way to get out of the contract? For now, I strongly recomend to pay the fee as you will save lots of money in the long run! Do the math: I paid $731 for early termination fee. My first bill was about $200 more (100 extra per month). If you do the math for 5 years (60 months) you will be paying almost $6000. And remember that you get a discount at the start of the contract then it goes up about 20%. And you know what is even more funier, I got a notice in the mail saying that my price per KWH is going down! Sad that I actually was thinking these retards would save me money!!!!

GOOD LUCK!
Gerry wink!

Hi all

I had a UE rep come to our door last night, at 8:15pm just as we were sitting down to dinner. He introduced himself quickly, and immediately started into his spiel about how he wanted to ensure we were registered for the Hydro savings program. All I had to do was give him personal info and our last Hydro bill.

I told him I knew nothing about this program, since there had been no info sent to us from HydroOne that their reps would be coming to our door to register us. Plus, logically thinking, if he was from HydroOne, shouldn't he already HAVE all our info (KwH usage, account #, etc.) that would appear on the bill he wanted to see??

He quickly explained to me that they (UE) sell the energy to HydroOne, but could give us a better deal if I joined their 5 year program. I questioned if that meant we'd be switching suppliers, and he said 'no', everything would remain the same except for our 'great savings'.

When I said that I wasn't going to sign anything without more info, and wanted to check with HydroOne - nevermind that dinner was now getting cold - he asked if he could come back later - in '10 minutes or so!'. Finally, I told him I didn't have a bill from HydroOne - I get them electronically through Canada Post Epost (NOTE - a good line to make them leave, although true in my case! LOL!)

I DID NOT sign anything, but will keep a close eye on future bills just in case....

The best of luck to all who signed and are now trying to get out. I guess my interest in consumer protection, along with natural suspicion, came in handy this time!

Hi everyone,

I'm a former employee of an energy retailer. I worked with the company for approximately 2 years and had a fairly high level position. There's a good chance I've talked with a few of you over the phone. I like to think that I was one of the few "customer focused" people there ad did all I could within the system to help you guys out. The problem was, there isn't much wiggle room once an application has been reaffirmed over the phone (at which point it becomes a binding contract, subject to early termination fees).

If you guys have any questions for a "former insider", I would be happy to help.

One point for clarification (for the Ontario market ONLY as of June 2007 - this does not apply to BC). You have more than 10 days to cancel an application. In fact, you don't ever have to "cancel" your application. If you sign at the door and UE is unable to contact you within 60 days in order to reaffirm the agreement, the application is cancelled. The burden is on UE to get you to reaffirm over the phone or via email. If they don't have a clean reaffirmation, they can not lock you in to anything. Again... this is for Ontario only (as of June 2007).

You can cancel ANYTIME before reaffirmation. You are NOT locked in after 10 days. Check the terms and conditions (the fold-out) brochure.

My advice to all those who have decided to cancel and have not yet reaffirmed...

Step 1: Call UE and inform them you have had a chance to review the material and have decided to cancel. Don't yell or scream or be combative, it's not going to help you. Be calm and friendly... it's in your best interest. Tell them that is your final decision and would like a cancellation confirmation number. No matter what they tell you, they WILL be able to generate a cancellation confirmation number for you. Their objective is to stall your cancellation as long as possible in an attempt to persuade you to change your mind. Be firm but polite. Inform them you will be sending an email immediately reiterating your cancellation request.

Step 2: Send an email requesting cancellation. Include your name, application number (red number at the top right hand corner of the application), phone #, and reason for cancellation. Keep an archive of this email.

Step 3: Breathe a sigh of relief.

The natural gas contracts aren't all that bad, but the electricity contracts are TERRIBLE. None of the employees of these companies would go near an electricity contract... especially one with "balancing charges".

Here are some questions straight from UEC. This should clear up anything:

Who is Universal Energy Corporation?

Universal Energy Corporation is a Canadian Company. The company markets its electricity product offerings under the name Universal Power. The principals of the organization have in excess of 100 years of combined experience in the energy industry and are responsible for aggregating in excess of one million customer contracts since deregulation.

Is Universal Power licensed in Ontario?

Universal Power has been approved and licensed as an Electricity Retailer by the Ontario Energy Board (License #ER-2005-0261). Universal Power is required to follow the Code of Conduct, issued and amended by the Ontario Energy Board.

Are you affiliated with a local utility?

Universal Power is not affiliated with any Local Distribution Company (LDC).

What causes electricity prices to rise?

Electricity prices are determined by the competitive forces of supply and demand. The short-term or spot price fluctuates significantly from day to night, season to season, weekday to weekend. For instance, if one generation facility is out of service in the middle of a heat wave our demand for electricity can easily exceed our supply capacity thus having to import electricity from neighboring regions which affects the short term price of electricity.

Longer term electricity prices are determined by population and economic growth and by factors such as environmental polices.
How do I benefit by signing with Universal Power?

There is no risk of your electricity commodity price increasing during the term of this agreement. As in the past your LDC delivers your electricity and provides 24 hours, emergency service. There is no cost to enroll.

If I chose Universal Power as my supplier, will I receive my utility bill from you?

Your bill will come directly from your LDC as it has in the past. Once, your application has been accepted by Universal Power, our name will appear on your bill as your electricity supplier.

Can I cancel this agreement?

At any time from the date of entering into the Universal Power's Agreement until 10 days after receiving a written copy of the agreement. If Universal does not make delivery within 30 days after the delivery date specified in this agreement or if Universal Power does not begin performance of its obligations within 30 days after the commencement date specified in this agreement, you may cancel this agreement at any time before delivery or commencement of performance.

Man and that was all on thier website which is on the application as well as the pamphlet. You people are just dumb and lazy you deserve to get fucked lol

Hello

There seems to be a scam going on with the above company conning
people onto signing up with them for 5 years and charging outrageous
prices.

We believe that my husbands signature was forged by this company to
enable them to take over our gas account.

Internet investigation has lead me to many, many other victims.

Are you investigating this Company at all ?

Thanks
